Flight delays are incredibly frustrating, particularly if they occur at the start of your holiday. Unfortunately some delays are unavoidable. However there are also many times when flight delays occur due to the fault of the airline. When this happens you have the right to make a claim for a flight delay.

When can you make a flight delay claim?

In order to make a claim for a flight delay, you must have:

  • Been delayed for three hours or more
  • Flown within the last six years
  • Been on an EU regulated flight (EU regulated flights include all flights which has departed from an EU airport or where an EU airline landed at an EU airport)
  • Been delayed due to something within the airlines control.

Events such as bad weather, political problems or security or safety issues including the recent volcanic ash incident are not within the airline’s control and therefore you are unlikely to be able to make a flight delay claim.

However if the delay could have been avoided then you have a good chance of making a successful claim for a flight delay. Common examples include:

  • The crew or pilot is late
  • The flight was cancelled due to under booking
  • Technical problems caused by the airline.
